British citizen Shaun Monaghan has been found engaged in illegal human traffic.

Tashkent - the city to gain from. This motto has been proved right many times for the people of different nationalities and origins. From time immemorial many thousands of people attempt to find the happiness here. The English citizen Monaghan Shaun became one of them. As a cook, he managed to be noted in this field in Great Britain, the USA, the United Arab Emirates, Saudi Arabia and even India. Alas, the cook happiness seemed a little attractive to the adventurer and «personal Klondike». Brave Shaun decided to test himself in quality of «the large businessman» in far Uzbekistan.

Having decided to begin the professional life from scratch - it didn't stop even a personal victims and he has married the citizen of exotic Uzbekistan Lazareva Larisa Anatolyevna. Marriage appeared the mutually advantageous enterprise - newly appeared spouses opened a company in Tashkent and employed Uzbek citizens for work abroad.

"Key" for success of this sort of activity in the country was a virtue of all the necessary contacts and communications with right people. First of all, British nationality that made indelible impression upon the clients and then ability to open all necessary doors: from night clubs/brothels to apartments of ambassadors and consuls of her Majesty. Secondly, old business "friendship" and interests with diplomats and the consular staff of embassy of Great Britain in Tashkent allowed the company to look respectful in the eyes of seekers of job abroad and potential employers in the United Arab Emirates. Last but not least - a successful matrimony in which local nationality of the spouse Larisa Lazareva opened all the possibilities for the solution of delicate questions of "joint venture" with a number of the corrupted officials in Tashkent.

Practically business appeal of the United Arab Emirates, in particular Dubai is around the world's most known. Not only as an offshore zone and one of shopping centers of the world, but also as the city opening huge possibilities for business and employment opportunities. On this last factor Shaun and Larisa have decided to build up the «family happiness».

Having registered Limited company under the name of "Lalsat-Servis", Larissa Lazareva with help of Shaun Mohaghan started to advertise their activities for international employment sphere in the United Arab Emirates. For the first placements Shaun has involved all the contacts and British citizenship that were helping much at his communication with employers and job seekers – that all really appeared successful!

Practically without any profit if not to tell at a loss, spouses sent abroad about seven citizens of Uzbekistan. Such course made stunning success - the message about "all-powerful" Shaun and Lalsat with speed of light was carried among hunters of job abroad.

It minimized risk of "claims" from outside "dissatisfied" candidates as the firm actually took money only for the meeting of job seeker with potential employer looking for cheap laborer. Candidates were not informed how strict are the rules of the labor and immigration legislation in the United Arab Emirates, and also about the real conditions provided by employers. At any time our citizens could appear abroad without any protection.

In fact Lalsat Servis in close and mutually beneficial connection with foreign employers provided illegal selection and plecement of cheap labor force abroad. Criminal activity poured out in the whole bouquet of penal acts: various dollar requisitions from candidates weren't fixed in documents of accounting and financial statements; Lalsat intentionally reduced the taxable base for the purpose of leaving from payment of lawful payments in the state budget, entered into practice extortion of additional currency from candidates for the departure, even concluded the contract with the employer regardless the fact that the foreign employers completely paid «Lalsat-Servis» all the expenses for selection of staff, provided visas and tickets. The most important that Lalsat management found to be involved in illegal human trafficking and a number of crimes committed in Uzbekistan and in United Arab Emirates.

The British Shaun Monaghan, actually was holding a post of the general manager at Lalsat Servis and took active part in interviewing candidates and was acting illegally without having a special permission of external labor migration of the Ministry of Labour and Social Protection of the population giving the right of implementation of international recruitment activity in Uzbekistan.

Such kind of activity on the territory of Uzbekistan without official additional organizational and tax procedures gave exceptional possibility to foreign employers to save considerably the operating costs carrying out mutual settlements with Shaun Monaghan in private and cash payments. All are glad are drunk, except the enslaved citizens of Uzbekistan and the budget of Uzbekistan which during this time suffered a significant damage and did not receive a large number of financial receipts in the form of tax and other payments due.

Lalsat-Servis not having any licenses or other allowing documents allowing for international recruitment services, using freedom of business in the country regarded as of paramount importance the activity receiving the maximum profits by means of the conclusion of enslaving contracts with candidates and fictitious contracts with employers. Shaun Monaghan being the cofounder and the general manager could not be unaware of what is happening in the firm. Criminal activity didn't remain unnoticed and from law enforcement agencies of Uzbekistan and the United Arab Emirates.

As a result of work of investigating authorities, Larisa Lazareva, her deputy A.Vaseyko and the accountant V. Makarenko were instituted criminal proceedings on a number of crimes and appeared behind a steel lattice of the Uzbek justice. Modern slave traders building the future on illegal human trafficking are sentenced to 5 years of imprisonment, with deprivation of the right to work at leading and materially responsible positions for a period of three years.

Another is remarkable, - «the brave fighter Shaun» as in the fairytale about Kolobok left untouched once again. Despite direct partnership of Monaghan Shaun in all crimes, he wasn't instituted criminal proceedings. Foreign citizenship and assistance of the English party once again allowed him to avoid fair punishment for crimes. But hopefully and this fairy tale will have a fair result and Shaun will manage to meet justice still in his new place.

Another story of activity of embassy of Great Britain in Uzbekistan is remembered. Then the employee of embassy of Great Britain was condemned for 6 years of jail for the similar crime connected with human trafficking.

In all these "stories" one thing is alerting: from time in time on «strange coincidence» citizens of Great Britain who are considered as one of the «old democracies», who are not missing any possibility to dictate in instructive tone to other countries how to build "constitutional state", appear in the center of the international scandals on such shameful affairs as "human trafficking"!

Emirates Airlines go criminal for recruitment in CIS with Lalsat

I have been through this story since 2011 when one of my friends tried to find job at Emirates Airlines and applied for opened vacancy at Lalsat International website.

Many qualified job seekers in former CIS space are looking for an international career opportunities and that is how hard it is to find one in a legal way.

It has been found strange that there is no any office Lalsat have in any of the locations they operate and the first question was asked: Do you have licence for employment of Russian citizens abroad? No feedback followed for the question and it was hardly possible to reach agency on the mobile number mentioned on the website and no clear answers were given.

Request has been sent to Federal Immigration authority to find out if Lalsat is operating legally in Russia? The answer was that there is no any information about such company operating in the country. She asked authority to look at this matter, take measures and afterwards the interview has been cancelled in Russia.

Anyone looking for a job outside the home country is very concerned about safety and legality of the process, especially when it comes to a Muslim countries such as UAE.

Going further, it has appeared on the Emirates careers website that the interview in going to take place in Kiev (Ukraine) with the same support of Lalsat. It is not a big distance and my friend decided to travel for interview in Kiev. Let's give it a try…

Immigration laws in Ukraine are even more strict than in Russia, however information is open online and it is possible to get the list of all licensed agencies who are legally recruiting in the local market. Ministry of Labor and Social Politics is overseeing international recruitment in Ukraine. Latest update for licensed agents was published in February 2012 here on Ministry offcial website (latest one is on top): http://www.mlsp.gov.ua/control/uk/publish/category?cat_id=35699 - Lalsat has not been listed there as of February 2012 whereas the interview is scheduled in March which is illegal without license.

The question of how legal the employment was a priority number one and looking furhter, my friend has found out there is a company registered in Kharkov (Ukraine) in September 2011 under the name of Lalsat International Ukraine however it has no legal righ to make international recruitment as it does not have office and license. Either in Ukraine or Russia it is impossible to get license without office – this is one on the most crusial license requirements. It has come as a big surprise how Emirates Airlines are engaged in such doubtful business and they seemed to have no idea of who they are dealing with as the Emirates staff responeded by e-mail ensuring Lalsat legal status is sound. However it has officially been confirmed by authorities that they have no license for business they run neither in Ukraine nor in Russia.

This situation has puzzled my friend and the dream of finding legal perspective job overseas seemed to be faring away.

Searching on Internet it has been found out that Lalsat has previously been operating in Tashkent (Uzbekistan) before their office has been closed by local authority and cheif accountant has been prisoned, director Larisa left for UAE. The owner\partner of business Shaun Monaghan has run away with the breach of stay stamp in passport. Now the new director of Lalsat International Ukraine Viktoria Borisova and Shaun Managhan are put on wanted list in Ukraine for illegal international recruitment activities.

It feels like these guys are used to work not in line with the law. The question stays open, why Emirates are doing illegal business with them? It sad that one can not easily find a way to safely apply for an intersting job overseas. Let's encourage employers to carefully observe the recruitment process to follow and respect the laws of the foreign countries where they recruit.

Очередной британский подданный оказался замешан в торговле людьми

Ташкент - город хлебный. Этот девиз заставлял ни раз, и не два убеждаться в своей правоте людей самых разных национальностей и происхождения. Испокон веков сюда тянулись многие тысячи людей в попытках обрести свое счастье. Одним из них стал английский поданный некий Монахан Шон (Monaghan Shaun). По профессии повар, он успел отметиться на этом поприще в Великобритании, США, ОАЭ, Саудовской Аравии и даже Индии. Увы, поварское счастье показалось мало привлекательным для искателя приключений и «персонального Клондайка», и бравый Шон решился попробовать себя в качестве «крупного бизнесмена» в далеком Узбекистане.

Решив начать свою профессиональную жизнь с нуля - он не остановился даже перед личными жертвами и «связал себя по рукам и ногам» узами Гименея с гражданкой экзотического Узбекистана Лазаревой Ларисой Анатольевной. Брак оказался взаимовыгодным предприятием - новоявленные супруги создали в Ташкенте фирму «по подбору и отправке кадров» для работы за рубеж.

«Благо» для успешной деятельности подобного рода предприятия у Шона имелись все необходимые задатки и связи. Во-первых, наличие британского гражданства, что производило неизгладимое впечатление на очередную партию клиентов и открывало перед его владельцем все нужные двери: от ночных клубов/притонов до апартаментов послов и консулов Ее Величества. Во-вторых, давняя бизнес «дружба» по интересам с дипломатами и консульскими сотрудниками посольства Великобритании в Ташкенте позволяли выглядеть фирме респектабельной в глазах как соискателей работы за рубежом, так и потенциальных работодателей в ОАЭ. В третьих, удачное супружество, в котором местное гражданство благоверной открывало возможности для решения щекотливых вопросов «совместного предприятия» с отдельным рядом коррумпированных чиновников.

Практически во всем мире известна бизнес-привлекательность ОАЭ, в частности Дубая. Не только в качестве оффшорной зоны и одного из торговых центров мира, но и как города, открывающего огромные возможности для ведения бизнеса и хорошего трудоустройства. На этом последнем факторе и решили построить свое «семейное счастье» «предприимчивые» супруги.

Зарегистрировав ООО под названием «Lalsat-Servis», Лариса Лазарева с помощью бравого Шона начали активно рекламировать свою деятельность по оказанию услуг в сфере трудоустройства в ОАЭ. Первые удачные отправки, для которых Шон задействовал все имевшиеся в его распоряжении контакты и связи - действительно оказались удачными.

Практически без всякой прибыли, если не сказать себе в убыток, супруги отправили за рубеж порядка семи граждан Узбекистана. Такой ход имел ошеломительный успех - весть о «всемогущем» Шоне со скоростью степного ветра разнеслась среди искателей работы за рубежом.

Далее супруги решили не «упустить свой шанс» и ловить Фортуну, пока, как им казалось, она смотрела им в лицо. Восторженные отзывы о фирме резко сменились негативными отзывами, а то и просто откровенными жалобами. Это было связано не только с ценой в размере от 1500 до 2000 долларов США, за которую фирма занимались «подбором и отправкой граждан» Узбекистана, но и тем, что сказочные обещания о «молочных реках» и «кисельных берегах» никак не соответствовали действительности. В результате мошеннических трюков да и просто преступного обмана, ряд доверчивых граждан РУ оказались в положении рабов у отдельных недобросовестных работодателей Эмирата Дубай. Следует отдать должное «профессиональным» . навыкам Шона. Его предыдущий богатый опыт менеджера ночного клуба в ОАЭ помогал ему безошибочно определять подходящую категорию сотрудников для арабской «клиентуры»: кого сиделкой/проституткой для развратных арабских нуворишей, а кого за долги на каменоломни по строительству очередных ветвей на островах «Пальм Дубая».

Изначально взятый на вооружение принцип работы «Lalsat-Servis»: «не брать никакие обязательства по контролю за условиями работы у работодателя», «не гарантировать ничего конкретного по обеспечению прав и законных интересов кандидатов» стали бесценной добавкой к длинному списку мошеннических трюков о том, как делать деньги из воздуха. Это сводило к минимуму риск «претензий» со стороны «недовольных» кандидатов, поскольку фирма фактически брала деньги лишь за сведение желающих работать и нуждающихся в дешевой нелегальной рабочей силе из ОАЭ. Кандидатов заранее не информировали о строгих правилах трудового и иммиграционного законодательства ОАЭ, а также о реальных условиях, предоставляемых им работодателями. В любой момент наши граждане могли оказаться за бортом без какой-либо защиты.

Фактически ООО «Lalsat-Servis» в тесной более чем взаимовыгодной связи с иностранными работодателями обеспечивало незаконный подбор и отправку дешевой трудовой силы заграницу. Преступная деятельность вылилась в целый букет уголовно наказуемых деяний: различные долларовые поборы с кандидатов не фиксировались в документах бухгалтерской и финансовой отчетности; ООО намеренно уменьшало свою налогооблагаемую базу с целью ухода от оплаты законных платежей в бюджет государства, фирма ввела в практику вымогательство дополнительной валюты с кандидатов на выезд, даже заключивших контракт с работодателем. Это при том, что принимающая сторона полностью оплачивала расходы «Lalsat-Servis» по подбору кадров. Самое главное руководство фирмы оказалось вовлечено в незаконную торговлю людьми и ряд преступлений совершенных как в РУ таки в ОАЭ.

Британский подданный Монахан Шон, не имея специального разрешения Агентства по вопросам внешней трудовой миграции Министерства труда и социальной защиты населения на право осуществления трудовой деятельности в Узбекистане, фактически числился генеральным менеджером и в этом качестве принимал активное участие в собеседованиях с кандидатами.

Помимо этого представителям арабских фирм-работодателей обеспечивались визовая поддержка и необходимая организационная и техническая помощь, для беспрепятственного подбора кадров путем проведения экзаменов и устных собеседований в Ташкенте.

Осуществление такого вида деятельности на территории Узбекистана без официальных дополнительных организационных и налоговых процедур дал прекрасную возможность иностранным работодателям значительно экономить свои текущие расходы проводя взаиморасчеты с Шоном в частно-наличном. Все рады пьяны, кроме закабаленных граждан РУ и бюджета Узбекистана, который за это время понес значительный ущерб и недополучил большое количество финансовых поступлений в виде налоговых и иных выплат.

Фирма «Lalsat-Servis» не имея каких-либо лицензий или иных разрешительных документов для оказания этих услуг, пользуясь свободой ведения бизнеса в стране поставила во главу угла своей деятельности получение максимальных прибылей посредством заключения кабальных контрактов с кандидатами и фиктивных договоров с работодателями. Даже не верится в то, что Монахан Шон, будучи соучредителем и генеральным менеджером, не знал о том, что происходит в своей фирме. Преступная деятельность не осталась незамеченной и со стороны правоохранительных органов Узбекистана и ОАЭ.

В результате работы следственных органов, Л.Лазарева, ее заместитель А.Васейко и бухгалтер В.Макаренко были привлечены к уголовной ответственности по ряду преступлений и оказались за стальной решеткой узбекского правосудия. Наверстывая «упущенное» им теперь придется внимательно читать и изучать приговор Мирабадского районного суда по уголовным делам. Современные работорговцы строившие свое будущее на незаконной торговле людьми приговорены к 5-ти годам лишения свободы, с лишением права работать на руководящих и материально-ответственных должностях сроком на три года. Думается эти меры позволят им по новому взглянуть на то, как жили последнее время и начать по новому строить свое будущее.

Примечательно другое, - «бравый вояка Шон», как в сказе про Колобка ушел в очередной раз от ответственности. Несмотря на прямое соучастие Монахана Шона в преступлениях, он так и не был привлечен к уголовной ответственности. Иностранное подданство и содействие английской стороны в очередной раз позволили ему избежать справедливого возмездия за преступления. Но думается и у этой сказки будет справедливый итог и Шон успеет еще встретиться с правосудием.

Вспоминается другая история из деятельности посольства Великобритании в Узбекистане. Тогда сотрудник посольства Великобритании за аналогичное преступление, связанное с торговлей людьми, был осужден на 6 лет.

Во всех этих «историях» настораживает один существенный момент: из раза в раз по «странному совпадению» подданные Великобритании, считающейся одной из «старых демократий», не упускающей любой возможности в назидательном тоне диктовать другим странам, как им строить «правовое государство», оказываются в центре международных скандалов по таким позорным для уважающей себя страны делам как «торговля людьми»!
